Maternity Rights
This table is a summary of employees' entitlements to Ordinary Maternity Leave (OML), Additional Maternity Leave (AML) and Statutory Maternity Pay (SMP) including how much notice they have to give you. Employees may be entitled to longer periods of leave or higher payments where this is specified in their contract of employment.

OML
|
All pregnant employees qualify for OML.
|
26 weeks' leave.
|
Notify employer before the end of 15th week before the week the baby is due.

AML
|
All pregnant employees qualify for AML.
|
26 weeks' leave beginning immediately after the end of OML.
|
AML follows on from OML. No separate notice is required.
|
|
SMP
|
Pregnant employees earning at least £90 per week with 26 weeks' continuous service with their employer into the 15th week before the week the baby is due.
|
39 weeks paid at 90 per cent of her average weekly earnings for the first six weeks and lesser of £123.06 or 90 per cent of her average weekly earnings for the next 33 weeks.

Notify employer 28 days before the start of SMP. Can be done at the same time as notification for OML (above).
